Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Orange Nuts mobile application and website (the "Service") operated by KheniTech ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you are at least 18 years of age and that you accept these Terms. The Service is intended exclusively for adults; persons under 18 may not create an account or use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your Account

• You must sign in with a valid Google or Apple account. You are responsible for keeping your sign-in credentials secure.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information and keep your profile details up to date.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

You may use the Service to create brands, generate social media posts with AI assistance, manage projects, and publish content to your social media accounts. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Post, generate, or distribute content that is defamatory, obscene, harassing, or infringes on the rights of others.
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
• Use automated tools to scrape, crawl, or bulk-access the Service without our prior written consent.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service.

4. User Content

You retain ownership of all content you create and upload through the Service ("User Content"), including brand profiles, posts, images, and project data.

By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, display, and process your User Content solely for the purpose of providing the Service to you. We do not use your content for advertising or share it with third parties for commercial purposes.

You are solely responsible for your User Content. We do not endorse any User Content and have no obligation to pre-screen it.

5. Community Safety & Moderation

Orange Nuts includes a public Feed where authenticated users can share and view social posts. We have zero tolerance for objectionable content and abusive users. By using the Service you agree to the following:

• Reporting objectionable content: Every post in the Feed includes a Flag button. Use it to report content you believe is abusive, harmful, or otherwise objectionable. Reports are submitted to our moderation team immediately.
• Blocking abusive users: You may block any user directly from their post in the Feed. Blocked users' content is removed from your Feed instantly. You may unblock a user at any time from your Profile settings.
• Developer response: We will review all reports of objectionable content within 24 hours of receipt. Content found to violate these Terms will be removed from the Service immediately, and the user who provided it will be ejected from the platform.
• Our commitment: We actively moderate the Feed to prevent abusive behaviour. Repeat or severe violations result in permanent account termination.

6. AI-Generated Content

Orange Nuts uses artificial intelligence (via the Base44 service) to generate post captions, brand descriptions, and images based on prompts you provide. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or unsuitable for your purposes. You are responsible for reviewing and editing output before publishing.
• You own the AI-generated content produced in response to your prompts, subject to the terms of the underlying AI service provider.
• Do not submit confidential, sensitive, or personally identifiable information of third parties as AI input.

7. Intellectual Property

The Service, including its design, code, logos, and features (excluding User Content), is owned by us and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Service or any of its components to you.

8. Third-Party Services

The Service integrates with third-party services including Google Firebase, Google Sign-In, Apple Sign-In, and Base44. Your use of these services is also subject to their respective terms of service and privacy policies. We are not responsible for the availability or conduct of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $10 IF YOU HAVE NOT MADE ANY PAYMENTS).

11. Termination

You may stop using the Service and delete your account at any time from the Profile screen. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law.

Upon termination, your right to use the Service ceases immediately. Sections 4 (User Content — ownership), 7 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 13 (Governing Law) survive termination.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. We will make reasonable efforts to notify you of material changes (for example, via an in-app notice). Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
